Practical guides for landlords, tenants, business owners, and NRI property owners in Mumbai, Navi Mumbai, and Thane.
RENTAL GUIDE
Documents to organise for a Leave & License Agreement
Starting with complete, consistent details helps reduce drafting delays. Before you begin, make one folder for the property, the owner, and the tenant.
Property & agreement details
- Complete property address and society/building details
- Monthly rent, refundable deposit, term, lock-in period, and payment date
- Any furnishings, parking, maintenance, or special conditions to be recorded
Party details
- Names and contact details exactly as used in the parties’ documents
- Identity and address documents requested through the authorised process
- Ownership or authority documents, where applicable
Checklist only: the right documents and registration steps can vary by property, parties, and the applicable official workflow. Ask for a tailored checklist before sharing documents.
LANDLORD CHECKLIST
Tenant verification: prepare before move-in
Tenant verification is easier when the landlord and tenant agree on the process before move-in. Keep your records organised and seek assistance with the relevant official or society requirements.
- Confirm the tenant’s complete contact details and proposed move-in date.
- Check the society’s move-in rules, notice format, and any forms required.
- Prepare a clear inventory or condition record for furnished properties.
- Keep a copy of the completed agreement and delivery/possession notes.
- Use an authorised or appropriate process for police-verification assistance where required.
Do not treat informal online messages as a substitute for the applicable verification or society process.
PROPERTY SUPPORT
Rental renewals and society paperwork: plan early
Set a reminder 30–45 days before an agreement ends. This leaves time to confirm revised rent, deposit, new term, and any changes in occupants or property terms.
For renewals
- Review the current agreement rather than copying it blindly.
- Record changes in rent, deposit, term, notice period, or occupancy.
- Confirm the required registration-assistance steps in advance.
For society documents
- Confirm the society’s current document checklist.
- Keep receipts, NOCs, and correspondence in one folder.
- Use a document handover list whenever originals are involved.
BUSINESS DOCUMENTATION
Commercial lease: the questions to settle before drafting
Commercial leases need more planning than a standard residential rental arrangement. Decide the business points first, then involve an advocate where legal drafting or review is required.
- Permitted business use and licences required for that activity
- Lease term, lock-in, escalation, deposit, and renewal rights
- Maintenance, repair, signage, fit-out, insurance, and utility responsibilities
- Exit, handover, and dispute-resolution provisions
This is general information, not legal advice. Commercial terms should be reviewed for the specific property and business.
